According to the most recent data available from the Center for Disease Control, 650 car passengers under the age of 12 died in car accidents in 2011, and more than 148,000 children under the age of 12 suffered injuries in crashes. Premises liability. A child’s natural inclination is to explore the world around him or her, whether that’s the playground, their neighborhood, or even places they’re not supposed to be. Under Florida law, a property’s owner is not liable for injuries suffered by a trespasser – but there’s a different rule for children. The property owner may be liable for a child’s injuries if they fail to block off potential man-made hazards that children are known to play around, such as a swimming pool or a rusted car on blocks.
Premises liability doesn’t just apply to situations where a child wanders onto another’s property; it also comes into effect in accidents that take place in public places such as amusement parks, playgrounds, city swimming pools, school grounds, and day care facilities.
